LADD SANGER RESOLVES HYPOXIA CASE INVOLVING LOSS OF CIRRUS SR22T OVER GULF OF MEXICO

Ladd Sanger represented the estate of a pilot who became incapacitated due to hypoxia while flying a Cirrus SR22T over the Gulf of Mexico. Hypoxia – caused by insufficient oxygen at altitude – can impair judgment, consciousness and the ability to operate an aircraft.

The case focused on the aircraft’s hypoxia detection and response system, which was intended to recognize cabin depressurization and automatically initiate a descent to a safer altitude. The system failed to activate, allowing the aircraft to continue on autopilot until it ultimately ran out of fuel and was lost over the Gulf. The aircraft was last tracked near Cancun, Mexico, and despite search efforts, no wreckage was recovered. The pilot was presumed dead.

Ladd pursued claims arising from the failure of this critical safety system, securing a confidential resolution on behalf of the estate. As a result of this litigation the avionics manufacturer located and fixed the software bug that prevented the emergency decent mode from activating. This fix was implemented across many aircraft types that used the same avionics package.
