Andy Payne Resolves a Major Case with Child Restraint Manufacturer

John Austin Smith was rendered a paraplegic while riding in a backless booster. Through hard-fought litigation, Andy uncovered evidence that a structural component failure observed in John Austin’s backless booster was previously recorded in governmental crash testing. The failures were repeated in both tests conducted by the U.S. government and the European Union. The structural component failure allowed slack to be introduced into the restraint system. This slack allowed John Austin’s upper torso to slide away from the shoulder restraint, allowing his lower body to hyperflex over the lap belt.This hyperflexion overstressed his spinal cord, leading to fractures and paraplegia. After depositions were completed and evidence uncovered, the case was settled for a substantial,confidential sum, prior to trial.
